Terms of Use

Translation notice. This document is a courtesy English translation of the French-language "Conditions Générales d'Utilisation (CGU)". Only the French version has legal force. In the event of any discrepancy or conflict of interpretation between the two versions, the French version prevails.

Article 01Purpose

These Terms of Use ("ToU") define the conditions for accessing and using the website anyonedream.com (the "Website") and the service for creating personalised comic books generated with the assistance of artificial intelligence (the "Service"), published by AnyoneDream, a SAS (the "Publisher").

Accessing the Website and using the Service imply full and unreserved acceptance of these ToU. Any User who does not accept the ToU must refrain from using the Service.

The applicable ToU are those in force on the day the Website is accessed.

Article 02Definitions

  • "Publisher": AnyoneDream, SAS, operating the Website and the Service.

  • "User": any natural person of legal age accessing the Website and/or the Service.

  • "Customer": any User who has placed an order on the Website.

  • "Generated Content": the personalised comic book (images, texts, storyline) created by the Service.

  • "User Data": the information and photographs provided by the User.

  • "AI": the artificial intelligence technologies used to provide the Service.

Article 03Access to the Service

The Service is accessible exclusively to natural persons of legal age (18 years or older) with full legal capacity. By using the Service, the User declares that they meet this condition.

The User undertakes to provide accurate, complete and up-to-date information. The Publisher reserves the right to suspend or restrict access to the Service, without notice, in the event of a breach of these ToU or of fraudulent or unlawful use.

The Publisher endeavours to ensure the availability of the Service but cannot guarantee continuous, uninterrupted access, in particular in the event of maintenance, technical constraints or reliance on third-party services.

Article 04Use of Artificial Intelligence - Transparency

The Service uses artificial intelligence technologies, provided by third-party suppliers, to generate the comic books. The User acknowledges being informed of this.

Given the nature of these technologies, the Publisher does not guarantee a precise result, nor a perfect likeness to the photographs provided (see Article 9).

In accordance with Regulation (EU) 2024/1689 on artificial intelligence, each item of Generated Content bears a notice indicating that it was created with the assistance of artificial intelligence, and may include metadata identifying the artificial origin of the content.

Article 05Obligations Relating to Photographs and Image Rights

Before transmitting any photographs, the User declares and warrants that they:

  • hold the rights to, or are duly authorised to use, the photographs transmitted;

  • have obtained the prior, free and informed consent of each identifiable person appearing in the photographs, in respect of their image rights;

  • will not transmit any photograph depicting a minor;

  • accept full responsibility in the event of a third-party claim relating to the photographs transmitted;

  • shall indemnify and hold the Publisher harmless against any claim, action, award, damage or cost (including defence costs) resulting from a breach of these warranties.

Article 06Prohibited Conduct

It is strictly prohibited to use the Service to transmit, generate, distribute or attempt to generate:

  • unlawful, defamatory, insulting, hateful, discriminatory, racist, violent, pornographic or child-abuse content;

  • photographs of third parties without their consent, or of minors;

  • content infringing the intellectual property rights, image rights or privacy of third parties;

  • content intended to impersonate a third party or to mislead.

It is also prohibited to interfere with the operation of the Website, to circumvent its security measures, or to extract its data by any unauthorised automated means.

Any breach may result in the immediate suspension of access, without prejudice to legal proceedings.

Article 07Intellectual Property

7.1 - Publisher's Rights

All elements making up the Website and the Service – including, without limitation, the AnyoneDream trademark (registered with the INPI under reference no. 5184061), the logo, the design, the technical architecture, the texts, the creative prompts and instructions, the personalisation algorithms, the generation processes, the source code, and all technical and creative know-how – are the exclusive property of the Publisher and are protected by intellectual property law, in particular Articles L111-1 et seq. of the French Intellectual Property Code.

Any reproduction, representation, modification, publication, transmission or distortion, in whole or in part, of the Website or its elements is strictly prohibited without the prior written authorisation of the Publisher.

7.2 - Rights in the Generated Content

The Publisher owns or holds the exploitation rights in the Content Generated by the Service, by virtue of the commercial licences granted by its artificial intelligence suppliers and of the Publisher's substantial creative input in designing the prompts, art direction, selection and assembly of results.

Following full payment of their order, the Customer receives a personal, non-exclusive, non-transferable and non-sublicensable licence to use the Content Generated from their data. This licence allows the Customer to:

  • keep, view and print the Content for their strictly personal and private use;

  • share the Content on their personal social networks, on a non-commercial basis, provided the "Created with AnyoneDream" notice is retained.

The Customer expressly agrees not to:

  • commercially exploit the Generated Content (in particular sale, licensing, merchandising) without the Publisher's prior written consent;

  • remove, hide or alter credit notices or AI-origin identification metadata;

  • use the Content to train artificial intelligence models;

  • reproduce or attempt to reproduce the generation process by circumventing the Service.

7.3 - User's Rights in Their Data

The User retains all rights in the User Data they provide (photographs, personal information). Transmitting this data to the Service does not constitute any transfer of ownership to the Publisher.

User Data is processed solely to provide the Service and is retained in accordance with the Privacy Policy.

Article 08Protection of Personal Data

Personal data is processed in accordance with the GDPR and the French Data Protection Act. The User has the rights of access, rectification, erasure, restriction, portability and objection, as well as the right to withdraw consent.

Article 09Liability and Limits of the Service

9.1 - Nature of the Service

The Service relies on artificial intelligence technologies provided by third-party suppliers. The Publisher acts as a technical and creative intermediary: it designs the generation instructions (prompts), assembles the results and carries out the final quality control, but does not directly produce the images and texts generated by the AI algorithms.

The Publisher undertakes to provide the Service with diligence and professionalism, under a best-efforts obligation (obligation de moyens) and not an obligation to achieve a specific result.

9.2 - Limits Inherent to Artificial Intelligence

The User acknowledges and accepts that:

  • results generated by AI are inherently variable and partly unpredictable;

  • the Publisher cannot guarantee a perfect likeness to the photographs provided, a specific artistic style, or the complete absence of visual or narrative imperfections;

  • AI technologies may produce unexpected results despite the control measures in place;

  • the Generated Content is provided "as is", within the technological capabilities of the AI tools at the time of generation.

9.3 - Content Generated by Third-Party Tools

The Generated Content is produced by artificial intelligence models operated by independent third-party suppliers. The Publisher cannot be held liable for:

  • biases, inaccuracies or artefacts inherent to the AI models used;

  • fortuitous similarities between the Generated Content and pre-existing works of which the Publisher is unaware;

  • the evolution, modification or interruption of third-party AI services, beyond its control;

  • the use or interpretation of the Generated Content by third parties.

The Publisher implements reasonable quality-control and moderation measures to limit the generation of inappropriate content, without being able to guarantee their absolute reliability.

9.4 - User's Liability

The User is solely responsible for:

  • the accuracy and lawfulness of the information and photographs they provide;

  • respecting the image rights of the persons depicted;

  • the use they make of the Generated Content after delivery, including any public distribution;

  • the consequences of any use of the Service that does not comply with these ToU.

The User undertakes to indemnify and hold the Publisher harmless against any claim, action or award resulting from a breach of these obligations.

9.5 - Limitation of Liability

In any event, and to the extent permitted by law, the Publisher's total liability in respect of an order is capped at the amount actually paid by the Customer for that order.

This limitation does not apply:

  • in the event of personal injury;

  • in the event of gross negligence or wilful misconduct by the Publisher;

  • in cases where the law prohibits or restricts such an exclusion.

Article 10Amendment of the ToU

The Publisher may amend these ToU at any time to reflect legal, technical or business developments. The applicable ToU are those in force on the day the Service is used. In the event of a material change, the User will be informed by appropriate means.

Article 11Governing Law and Dispute Resolution

These ToU are governed by French law.

In the event of a dispute, a User acting as a consumer may use a consumer mediation service free of charge, in accordance with Articles L611-1 et seq. of the French Consumer Code (see the Terms of Sale for the mediator's details).

In accordance with Regulation (EU) No 524/2013, the European Commission provides an online dispute resolution platform, accessible at: https://ec.europa.eu/consumers/odr

Failing an amicable resolution, any dispute falls within the jurisdiction of the competent French courts.
